Terms of Service

Last updated: October 2, 2026

Overview

Welcome to FNP Path. The terms "we", "us" and "our" refer to FNP Path. FNP Path operates the store at pathtofnp.com and the application at app.fnppath.com, including all related information, content, features, tools, products and services, in order to provide you with educational materials and study resources for nurse practitioners and nurse practitioner students (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with the policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully. They include important information about your legal rights and cover subscription billing and automatic renewal, digital product licensing, artificial-intelligence features, warranty disclaimers, limitations of liability, and a binding arbitration agreement and class-action waiver (Section 27).

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service, our Privacy Policy, our Delivery & Refund Policy, and our Disclaimer. If you do not agree, do not use or access the Services.

Section 1 — Eligibility and account

You must be at least 18 years old to use the Services. By agreeing to these Terms you represent that you are 18 or older. The Services are not directed to, and may not be used by, anyone under 18.

To use the Services you may be asked to provide information such as your name, email address, and payment details. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide it.

Access to purchased products is tied to the email address used at checkout. You are limited to one account, and to a reasonable number of personal devices; we may retire inactive devices and refuse access from devices beyond that limit. You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, share, assign, or license your account to any other person.

Section 2 — Educational purpose and no medical advice

Our products are educational and organizational reference materials for licensed clinicians and clinicians in training. They are not medical advice, do not establish a standard of care, and are not a substitute for professional clinical judgment, institutional protocol, or current prescribing information.

All clinical decisions remain yours, applied within your scope of practice and in accordance with your state regulations, institutional policy, and collaborative or supervisory agreement. You are responsible for verifying all clinical content, including medication dosing, against current primary sources before applying it in practice.

Clinical guidance in our materials reflects publicly available guidelines as of the publication date and is subject to change. We make no representation that any material is current, complete, or accurate at the time you use it.

Section 3 — No exam outcome guarantee and no affiliation

Our products are independent study resources. We do not guarantee any particular examination result, score, pass rate, certification outcome, academic grade, or professional or financial outcome of any kind.

FNP Path is not affiliated with, endorsed by, sponsored by, or otherwise connected to the American Academy of Nurse Practitioners Certification Board (AANPCB), the American Nurses Credentialing Center (ANCC), the American Association of Nurse Practitioners (AANP), any state board of nursing, any nursing school or academic program, or any organization whose clinical guidelines are referenced in our materials. References to any such organization are for identification and educational purposes only. Our content is written from publicly available exam blueprints and professional references and does not contain actual examination questions. All trademarks are the property of their respective owners.

Section 4 — Academic integrity

Our materials, including any templates, examples, and completed sample documents, are provided as structural references only. You must not submit any part of our materials as your own original academic work. Doing so may violate your program's academic integrity policy, and you are solely responsible for any consequence that results.

Section 5 — Our products

We have made every effort to represent our products accurately. Product appearance may differ from how it appears on your screen due to your device and its settings. We do not warrant that the appearance or quality of any product will meet your expectations or be the same as depicted in our store.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities of any product that we offer to any person, geographic region or jurisdiction.

Section 6 — Digital products and license

Digital products are licensed to you, not sold. Subject to your compliance with these Terms and payment in full, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to read, store, print, and use the digital product for your own individual study and clinical reference.

You may not: share, distribute, resell, rent, lend, sublicense, or publicly post any digital product or any part of it; upload it to any file-sharing service, study-material marketplace, course platform, group chat, or social-media group; use it to train, fine-tune, prompt, or evaluate any artificial-intelligence or machine-learning system; remove, obscure, or alter any copyright notice, watermark, or licence identifier; circumvent any download limit or access control; or reproduce it for use by a class, cohort, employer, or institution. Institutional, group, and educational licensing is available separately — contact us.

Delivery, offline reading and downloads. Digital products are delivered by unlocking them on your account in the FNP Path app. You may read them in the app without limit. Guides may be read inside the app, saved for offline reading on your own devices, and downloaded as a PDF up to three times per account for your personal use, including in note-taking and annotation apps. You may not extract content from the app or its offline storage by any other means. Every downloaded copy is watermarked with your name, email address, and a unique licence identifier that traces the copy to your account — visibly at intervals through the document and invisibly on every page; a shared copy identifies you as its source. You are responsible for retaining downloaded files. We do not guarantee that the app, any product, or any download will be available indefinitely.

Certain illustrations and third-party materials included in our products are licensed to us by their owners and remain subject to their own license terms, which are credited within the relevant product. Nothing in these Terms grants you rights in that third-party material beyond what those licenses allow.

Section 7 — Subscriptions, trials and automatic renewal

Some Services, including the FNP Mastery AI Coach, are offered on a recurring subscription basis. The following terms apply to any subscription you purchase.

Automatic renewal. Your subscription renews automatically at the end of each billing period, and your payment method on file will be charged the then-current subscription price, until you cancel. Billing periods and prices are disclosed at the point of purchase and in your order confirmation.

Introductory and trial pricing. Where an introductory or trial price is offered, your subscription converts automatically to the standard recurring price at the end of the introductory period unless you cancel before it ends. The introductory price, the standard price that follows it, and the date of conversion are disclosed to you before you purchase.

Cancellation. You may cancel at any time through your account page, the cancellation link in your order confirmation, or by emailing support@fnppath.com. Cancellation takes effect at the end of the current billing period. You will retain access through the end of the period you have already paid for.

No partial-period refunds. Except where required by law or provided in our Delivery & Refund Policy, subscription fees already charged are not refunded on a partial-period basis.

Price changes. We may change subscription prices. We will notify you in advance of any price change affecting your subscription, and the change will apply to billing periods beginning after the notice period. Your continued subscription after the effective date constitutes acceptance of the new price.

Section 8 — AI-assisted services

Certain Services, including the FNP Mastery AI Coach and its practice cases, use artificial-intelligence tools. The following applies to any such Service.

You are interacting with software, not a person. Responses from AI-assisted Services are generated automatically by large language models operated by third-party providers. No clinician, instructor, or FNP Path staff member reviews responses before you see them. The AI is not a nurse practitioner, physician, pharmacist, or licensed mental-health provider, and no provider–patient or professional relationship is created by your use of it.

Output may be wrong. AI-generated output may be incomplete, outdated, or incorrect, including on clinical topics such as drug names, doses, and thresholds. Output is not medical advice and must be independently verified against primary clinical sources before any clinical application. Practice cases and "patients" are fictional.

No protected health information. Do not enter protected health information or any patient-identifying information into any AI-assisted Service. FNP Path is not a HIPAA covered entity or business associate. Prompts you submit are transmitted to our third-party AI providers to generate a response and are stored on your account so you can return to your conversations.

Not for emergencies. AI-assisted Services are not a crisis, medical, or mental-health service. In an emergency call 911 or your local emergency number.

Availability and fair use. Availability depends on third-party platforms we do not control. We do not warrant uninterrupted availability, and we may modify, suspend, rate-limit, or discontinue any AI-assisted Service, or migrate it to a different provider, at any time. Usage limits apply and are shown in the app; automated, scripted, or excessive use may be throttled or terminated.

Section 9 — Orders, eligibility to purchase, and chargebacks

When you place an order, you are making an offer to purchase. FNP Path reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment first. Review your order carefully before submitting; we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change, or cancel an order, we will attempt to notify you at the email address provided with the order.

United States only. FNP Path products are prepared for the United States FNP certification process and are sold only to customers in the United States. Orders placed with a billing address outside the United States are not fulfilled and will be refunded.

Your purchases are subject to refund solely in accordance with our Delivery & Refund Policy. You represent and warrant that your purchases are for your own personal or professional use and not for commercial resale, redistribution, or export.

Chargebacks. If you have a problem with a purchase, contact us first. Filing a chargeback or payment dispute on a product you have opened, saved for offline, or downloaded, or purchasing with a payment method you are not authorized to use, is a material breach of these Terms and results in permanent closure of your account and loss of access to all FNP Path products, without refund. We provide our access, reading and download records to card issuers in every dispute.

Section 10 — Prices and billing

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes.

We may offer promotions governed by terms separate from these Terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms govern for that promotion.

You agree to provide current, complete and accurate purchase, payment and account information, and to promptly update it so that we can complete your transactions and contact you as needed. You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorized to use the payment method for the purchase, (iii) charges incurred by you will be honored by your card issuer, and (iv) you will pay charges incurred by you at the posted prices, including applicable taxes.

Section 11 — Delivery

All FNP Path products are digital. Nothing is shipped. Products are delivered by unlocking them on the account matching your checkout email at app.fnppath.com, normally within a minute of payment. If your products do not appear, follow the steps in our Delivery & Refund Policy or contact support@fnppath.com.

Section 12 — Intellectual property

Our Services, including but not limited to all trademarks, brands, text, questions, rationales, cases, displays, images, graphics, product reviews, video, audio, software, and the design, selection, and arrangement thereof, are owned by FNP Path, its affiliates or licensors and are protected by U.S. and foreign copyright, trademark and other intellectual-property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download (except as expressly permitted in Section 6), store, scrape, or transmit any material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants you any license or right under any patent, trademark, copyright, or other intellectual property of FNP Path, Shopify or any third party. All rights not expressly granted are reserved.

FNP Path's names, logos, product and service names, designs, and slogans are trademarks of FNP Path or its licensors and may not be used without our prior written permission. Shopify's name and marks are trademarks of Shopify. All other names and marks are the property of their respective owners.

Copyright complaints. If you believe material on the Services infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to support@fnppath.com with "DMCA" in the subject line.

Section 13 — Optional tools

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available" without any warranties or endorsement, and we have no liability arising from your use of them. Your use of optional tools is at your own risk, and you should review the terms on which they are provided by the relevant third party. New features we release are part of the Services and are subject to these Terms.

Section 14 — Third-party links

The Services may contain materials and hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites, and we are not liable for any harm or damages related to your use of them. Review the third party's policies before engaging in any transaction, and direct complaints about third-party products and services to the third party.

Section 15 — Relationship with Shopify

Our store is powered by Shopify. Any sales and purchases you make are made directly with FNP Path. Shopify is not responsible for any aspect of any sale between you and FNP Path, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with FNP Path.

Section 16 — Privacy

Personal information we collect is subject to our Privacy Policy, and information collected at checkout is also subject to Shopify's Privacy Policy. Payment is processed by Shopify; we never see or store your full card number. To run the app we store your email address(es) and account details, purchase and access records, reading positions and bookmarks, Question Bank answers, AI Coach conversations, sign-in device records with an approximate network location, and technical logs. Information you submit may be transmitted to and processed by Shopify, our hosting provider, and our AI providers, which may be located in countries other than where you reside. By using the Services you acknowledge that you have read these privacy policies.

Section 17 — Feedback and reviews

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including commercial use and promotion of the Services.

You represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation, free product, or incentive received in connection with your Feedback; (iii) your Feedback reflects your honest opinion and experience; and (iv) your Feedback complies with these Terms. We are under no obligation to maintain your Feedback in confidence, to compensate you for it, or to respond to it.

You must not include any protected health information or patient-identifying information in any Feedback. Your Feedback must not violate any third-party right, be unlawful, abusive, defamatory, or obscene, or contain malware. You may not use a false identity or mislead anyone as to the origin of Feedback. We may, but have no obligation to, monitor, edit or remove Feedback at our discretion. You are solely responsible for your Feedback and its accuracy.

Section 18 — Errors, inaccuracies and omissions

Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice, including after you have submitted your order.

Section 19 — Prohibited uses

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any law or regulation; (c) to infringe our intellectual-property rights or those of others; (d) to harass, abuse, harm, defame, or intimidate any person; (e) to transmit false or misleading information; (f) to send spam or unsolicited promotional material; (g) to impersonate any person or entity; or (h) to engage in any conduct that restricts or inhibits anyone's use of the Services or that may harm FNP Path, Shopify or users of the Services or expose them to liability.

In addition, you agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, spider, crawl, or scrape; (e) interfere with or circumvent the security features, access controls, download limits, or watermarks of the Services; (f) use bots, scripts, or automated tools to access the Services or to extract content, questions, or AI output; (g) probe, scan, reverse-engineer, or attempt to access the source code, servers, or data of the Services; or (h) share your account or access with any other person. We may suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

Section 20 — Termination

We may terminate this agreement or your access to the Services (or any part of them) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Termination of your account also terminates the license granted in Section 6, and you must cease use of and destroy any copies of our digital products in your possession.

The following sections survive termination: 2, 3, 4, 6, 8, 9, 12, 17, 20 through 30, and any other provision that by its nature should survive.

Section 21 — Disclaimer of warranties

The information presented on or through the Services is made available solely for general educational purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other person.

EXCEPT AS EXPRESSLY STATED BY FNP PATH, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

Section 22 — Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL FNP PATH, ITS OWNER, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, ANY EXAMINATION, ACADEMIC, LICENSURE, OR EMPLOYMENT OUTCOME, OR ANY CLINICAL DECISION OR PATIENT OUTCOME, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING ANY ERRORS OR OMISSIONS IN ANY CONTENT OR AI-GENERATED OUTPUT, EVEN IF ADVISED OF THEIR POSSIBILITY.

IN EVERY CASE, THE TOTAL AGGREGATE LIABILITY OF FNP PATH AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO FNP PATH IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Section 23 — Indemnification

You agree to indemnify, defend and hold harmless FNP Path, Shopify, and our respective owners, affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, (3) your use of our content or AI output in the care of any patient, or (4) your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims.

Section 24 — Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Section 25 — Waiver; entire agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms and the policies referenced in them constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us, including any prior versions of these Terms. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

Section 26 — Assignment

You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

Section 27 — Dispute resolution, binding arbitration and class-action waiver

Please read this section carefully. It affects your legal rights.

Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@fnppath.com with a description of the dispute and to work with us in good faith for at least 30 days to resolve it.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product, that is not resolved informally, shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. The Federal Arbitration Act governs this section. The arbitration may be conducted by video, telephone, or written submissions, or in person in the county where you reside. The arbitrator's award may be entered in any court of competent jurisdiction.

Class-action waiver. You and FNP Path agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this waiver is found unenforceable as to a particular claim, that claim shall be severed and proceed in court, and the remainder shall proceed in arbitration.

Exceptions. Either party may bring an individual claim in small-claims court if it qualifies. Either party may seek injunctive or other equitable relief in court to protect its intellectual-property rights.

30-day opt-out. You may opt out of this arbitration agreement by emailing support@fnppath.com with the subject "Arbitration opt-out" and your account email within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

Time limit on claims. Any claim arising out of or relating to the Services or these Terms must be filed within one (1) year after the claim arises, or it is permanently barred, to the extent permitted by law.

Section 28 — Governing law

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-law rules. Subject to Section 27, you and FNP Path consent to the exclusive jurisdiction and venue of the state and federal courts located in Florida.

Section 29 — Headings and changes to these Terms

Headings are included for convenience only and do not limit or otherwise affect these Terms.

You can review the most current version of the Terms at any time on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check periodically for changes. We will notify you of any material changes in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of the Services following the posting of changes constitutes acceptance of those changes.

Section 30 — Contact information
